1. General Information
- The Green Tech Data application (“Application”) is a B2B tool designed for documenting environmental installations, collecting evidence of the implementation of environmental projects (ZKP), calculating environmental impacts, ESG reporting, and preparing materials for audit, certification, and offsetting processes.
- The administrator of the Application is: SOFTWARE LIMITED, 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom, company number: 08062889, e-mail: info@greentechdata.com (“Administrator”).
- These Terms and Conditions define the rules for using the Application, the rights and obligations of Users, and the scope of the Administrator’s liability.
2. Definitions
a. User – a natural person acting on behalf of an entrepreneur, organization, or institution using the Application in the course of its business activity.
b. Account – an individual User profile created within the Application.
c. Project Data – all information, documents, photographs, location data, technical parameters, and other materials entered into the Application.
d. ZKP – a set of data and documents constituting evidence of the implementation of environmental projects.
e. Personal Data – any information enabling the identification of the User, processed in accordance with the Privacy Policy.
3. Scope of Services
The Application enables, in particular:
- documentation of environmental installations,
- collection and archiving of ZKP,
- recording of photographs and location metadata,
- calculation of environmental and offsetting impacts,
- preparation of ESG reports,
- sharing of data for audit and certification purposes.
4. Terms of Use
- The User undertakes to enter data that is true, complete, and consistent with the actual state of affairs.
- It is prohibited to enter false, manipulated, or inaccurate data.
- The User bears full responsibility for the content and materials entered into the Application.
- The User undertakes to use the Application in compliance with applicable laws, including regulations on personal data protection and provisions concerning the protection of the Administrator’s intellectual property.
5. User Account
- Use of the Application requires the creation of an Account.
- The User is responsible for the security of their login credentials.
- The Administrator may block an Account in the event of a breach of these Terms and Conditions.
- The User may delete their Account and Project Data at any time via the “Delete Account” function in the Application or by submitting a declaration by e-mail to info@greentechdata.com. Deletion of the Account results in the permanent removal of all Project Data entered by the User. Account deletion results in the permanent removal of all Project Data entered by the User and cannot be reversed.
6. Data Ownership and Licence
- The User retains all rights to their Project Data.
- The User grants the Administrator a non-exclusive, royalty-free, worldwide licence to use the Project Data to the extent necessary to:
- provide the Application’s services,
- carry out audit, certification, reporting, and offsetting processes,
- perform evidentiary archiving.
- The User does not acquire any intellectual property rights to the source code, graphics, interface, or functionalities of the Application beyond the rights arising from this licence. All intellectual property rights to the source code, graphics, interface, and functionalities of the Application belong exclusively to the Administrator.
7. Liability
- The Administrator shall not be liable for the accuracy or truthfulness of data entered by the User.
- The Administrator shall not be liable for business, investment, or reporting decisions made on the basis of data from the Application.
- The Administrator shall not be liable for the consequences of using Project Data in certification, offsetting, reporting, or investment processes.
8. Security and Personal Data
The rules for the processing of personal data are set out in the Privacy Policy available in the Application and on the website.
9. Term and Termination of the Agreement
The agreement is concluded for an indefinite period and may be terminated at any time by the User or the Administrator.
10. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be resolved by the competent courts in London.
11. Final Provisions
- The Administrator reserves the right to amend these Terms and Conditions for valid legal, technological, or business reasons.
- The Administrator will inform the User of any changes to the Terms and Conditions within the Application and by e-mail at least 7 days prior to the effective date of the changes. Failure by the User to accept the changes within this period entitles the User to terminate the Agreement without additional fees.
