Terms and Conditions of Use of the Green Tech Data Mobile and Web Application

1. General Information

a. The Green Tech Data mobile and web application (“Application”) is a B2B tool used to document environmental installations, collect evidence of environmental project implementation (ZKP), calculate environmental effects, prepare ESG reports, and generate materials for audit, certification, and offset processes.

b. The Application is operated by: SOFTMARE LIMITED, 27 Old Gloucester Street, London, WC1N 3AX, United Kingdom, Company No: 08062889, e-mail: info@greentechdata.com (“Administrator”).

c. This Terms of Use defines the rules for using the Green Tech Data mobile and web application, the rights and obligations of Users, and the scope of the Administrator’s liability.

2. Definitions

a. User – a natural person acting on behalf of a company, organization, or institution using the Application within the scope of business activity.

b. Account – an individual profile created by the User in the Application.

c. Project Data – all information, documents, photos, location data, technical parameters, and other materials entered into the Application.

d. ZKP – a set of data and documents constituting evidence of environmental project implementation.

e. Personal Data – any information that can identify the User, processed in accordance with the Privacy Policy.

3. Scope of Services

The Green Tech Data mobile and web application allows Users to:

a. Document environmental installations,

b. Collect and archive ZKP,

c. Register photos and location metadata,

d. Calculate environmental and offset effects,

e. Prepare ESG reports,

f. Share data for audit and certification purposes.

4. Terms of Use

a. Users must enter truthful, complete, and accurate data.

b. Entering false, manipulated, or inaccurate data is prohibited.

c. Users are fully responsible for the content and materials they enter into the Application.

d. Users must use the Application in compliance with applicable laws, including data protection regulations and intellectual property rights of the Administrator.

e. Users acknowledge that the Application is not a verifier or auditor of data or projects.

5. User Account

a. Using the Application requires creating an Account.

b. Users are responsible for the security of their login credentials.

c. The Administrator may block an Account in case of violation of these Terms of Use.

d. Users may delete their Account and Project Data at any time via the “Delete Account” function in the Application or by sending a written request via e-mail to info@greentechdata.com. Deleting the Account results in permanent removal of all Project Data entered by the User and cannot be undone.

6. Data Ownership and License

a. Users retain ownership of their Project Data.

b. Users grant the Administrator a non-exclusive, royalty-free, worldwide license to use Project Data to the extent necessary for:

  • Providing the Application services,
  • Conducting audit, certification, reporting, and offset processes,
  • Evidence archiving.

c. Users do not acquire any intellectual property rights to the source code, graphics, interface, or functions of the Application, except for the rights granted under this license. Intellectual property rights to the source code, graphics, interface, and functions of the Application remain solely with the Administrator.

7. Liability

a. The Administrator is not responsible for the accuracy of data entered by the User.

b. The Administrator is not responsible for business, investment, or reporting decisions based on data from the Application.

c. The Administrator is not liable for the use of Project Data in certification, offset, reporting, or investment processes.

d. The Application ensures methodological compliance and full data traceability, but material responsibility rests with the project beneficiary and/or external auditor.

8. Security and Personal Data

The principles of personal data processing are defined in the Privacy Policy available in the Application and on the website.

9. Duration and Termination

The Agreement is concluded for an indefinite period and may be terminated at any time by either the User or the Administrator.

10. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of England and Wales. Any disputes will be resolved by the competent courts in London.

11. Final Provisions

a. The Administrator reserves the right to amend these Terms for valid legal, technological, or business reasons.

b. Users will be informed of any changes to the Terms via the Application and e-mail at least 7 days before they take effect. Failure to accept the changes within this period allows the User to terminate the Agreement without additional charges.
